RISARCIMENTO DEL DANNO: IL DANNO DA PERDITA PARENTALE
Il danno da perdita parentale riguarda tutte quelle persone che purtroppo hanno perso un parente a causa, ad esempio, di un caso di malasanità o a causa di malattie dovute al lavoro del proprio congiunto.
Può essere richiesto se il parente della vittima sia un genitore, figlio, coniuge, convivente o parte dell’unione civile, fratello, nonno o bisnonno, nipote, zio o cugino.
Per quanto riguarda l’inquadramento giuridico di tale tipologia di danno, vi è stato da sempre un dibattito all’interno della Giurisprudenza italiana.
La Cassazione, infatti, con alcune sentenze, ha qualificato il danno da perdita parentale come un danno extracontrattuale, con altre invece l’ha ritenuto un danno contrattuale.
Le conseguenze di questa differente categorizzazione sono molteplici, soprattutto perché far rientrare il danno da perdita parentale nella categoria del danno contrattuale sarebbe più favorevole per il soggetto danneggiato, ossia il parente della vittima.
Innanzitutto, per quanto riguarda il termine di prescrizione dell’azione di responsabilità da danno patrimoniale, questo è di cinque anni nel caso in cui lo si ricolleghi alla responsabilità extracontrattuale, mentre è di dieci anni se viene intesa come responsabilità contrattuale.
In merito a questa seconda ipotesi, si richiama l’orientamento giurisprudenziale secondo il quale la responsabilità della casa di cura o dell’ente nei confronti del paziente ha natura contrattuale e può conseguire, ai sensi dell’art. 1218 c.c., all’inadempimento della prestazione medico-professionale svolta direttamente dal sanitario, quale suo ausiliario, pur in assenza di un rapporto di lavoro subordinato, comunque sussistendo un collegamento tra la prestazione da costui effettuata e la sua organizzazione aziendale (sentenza Cass. civ. n. 18610/2015).
La domanda, anche se avanzata da soggetti terzi rispetto al rapporto contrattuale tra paziente e struttura sanitaria, ossia i parenti, non assume tratti ostativi nella misura in cui l’efficacia del contratto può, in alcuni casi, estendersi a favore di terzi (sentenze Cass. civ. n. 20320/2005, Cass. civ. n. 16754/2012).
Alcune sentenze hanno però escluso che si potesse configurare un danno da responsabilità contrattuale proprio per la mancanza di rapporto contrattuale tra i parenti e la struttura ospedaliera. In tali casi, infatti, la responsabilità dell’azienda ospedaliera viene ricondotta, all’ambito di applicazione dell’art. 2043 Cod. Civ., ossia alla responsabilità extracontrattuale.
Oltre al termine di prescrizione inferiore, ne deriva anche una diversa attribuzione dell’onere probatorio, che in questo caso sarà in capo ai soggetti danneggiati.
Una recente sentenza della Cassazione (n. 14258/2020), in tema di responsabilità medica, ha escluso che si possa trattare di responsabilità contrattuale, appunto per la mancanza di un rapporto contrattuale tra i parenti della vittima e l’ospedale.
Di seguito riportiamo le Tabelle del Tribunale di Roma del 2018 che vengono seguite dai Tribunali italiani per la determinazione del danno parentale.
I criteri orientativi del Tribunale di Roma tengono in considerazione alcuni fattori che contribuiscono alla quantificazione economica del risarcimento.
1) il rapporto di parentela esistente tra la vittima ed il congiunto avente diritto al risarcimento, dovendosi presumere che il danno è tanto maggiore quanto più stretto è tale rapporto.
2) l’età del congiunto: il danno è tanto maggiore quanto minore è l’età del congiunto superstite. Tale danno infatti è destinato a protrarsi per un tempo maggiore.
3) l’età della vittima: anche in questo caso è ragionevole ritenere che il danno sia inversamente proporzionale all’età della vittima, in considerazione del progressivo avvicinarsi al naturale termine del ciclo della vita.
4) la convivenza tra la vittima ed il congiunto superstite, dovendosi presumere che il danno sarà tanto maggiore quanto più costante e assidua è stata la frequentazione tra la vittima ed il superstite.
